These Terms of Service constitute a legally binding regulatory instrument governing the access to, interaction with, and utilization of the digital, commercial, informational and transactional framework made available through this website and any associated platforms, operated by Lo-Cate. By accessing, browsing, engaging with, or conducting any transactional activity through the Service, the user expressly acknowledges and agrees to be bound by these Terms, as well as all policies, notices and compliance-related disclosures incorporated by reference. Failure to accept these Terms in their entirety requires the immediate cessation of all use of the Service.

Scope, Applicability and Legal Effect
These Terms regulate all engagements with the Service, including navigation, observation of product listings, initiation of purchase processes, conclusion of distance contracts, submission of personal data and all communications with the Company.
These Terms operate concurrently with mandatory consumer protection frameworks applicable within the European Union, the Kingdom of the Netherlands and the Portuguese Republic.
Where mandatory legal provisions conflict with any part of these Terms, such mandatory provisions shall prevail.

Eligibility and Legal Capacity
By using the Service, the User affirms possessing legal capacity, being of the age of majority and acting solely as an end-user consumer.
Illegal, fraudulent or unauthorized use of the Service is strictly prohibited.

General Operational Conditions
The Company reserves the right to refuse access to the Service at any time.
Data transmissions, excluding encrypted payment information, may occur across interoperable networks.
Unauthorized reproduction, exploitation, duplication or redistribution of any part of the Service is prohibited.

No warranty is provided regarding the completeness, accuracy or timeliness of information presented.
Reliance on such material is undertaken at the User's own discretion.

Product pricing may change without notice.
The Service may be altered, suspended or discontinued at any time without liability.

Products, Availability and International Fulfillment
Products offered through the Service may be limited in quantity and available exclusively online.
Efforts are made to present product imagery accurately, though device-based variations may occur.
Certain goods may be dispatched from international fulfillment centers, including facilities in China. Delivery timelines may range from 6 to 20 business days.
Customs duties, VAT reassessments and import tariffs may be levied by destination authorities and shall be borne by the User.
Risk of loss transfers only upon physical receipt by the User.

Contract Formation
Product listings do not represent binding offers.
Submission of an order constitutes an offer.
A binding contract is concluded only upon explicit acceptance or dispatch by the Company.

Prohibited Conduct
Prohibited activities include legal violations, intellectual property infringement, dissemination of malicious code, fraudulent behavior, scraping, unauthorized data extraction, disruption of security mechanisms and abusive or obscene conduct.

Warranty Disclaimer and Limitation of Liability
The Service is provided on an as-is and as-available basis.
To the maximum extent permitted by applicable law, the Company disclaims liability for indirect, incidental, punitive or consequential damages.
Mandatory consumer rights remain unaffected.

Indemnification
The User agrees to indemnify the Company for claims arising from breaches of these Terms or violations of applicable legal standards.

Severability
Invalid or unenforceable provisions shall not affect the enforceability of remaining clauses.

Termination
Either party may terminate access at any time.
Obligations accrued prior to termination remain enforceable.

Right of Withdrawal (14 Days – EU/NL/PT Mandatory)
Consumers possess the statutory right to withdraw from a distance contract within 14 calendar days.
The withdrawal period begins on the day following physical receipt of the goods, receipt of the final item in multi-item orders or receipt of the final lot in multipart deliveries.
Withdrawal is effected through an unequivocal declaration sent to info@lo-cate.com.
The consumer must return goods within 14 days of issuing the declaration and bears the cost of return.
The consumer is liable for diminished value caused by handling beyond what is necessary to determine the nature, functioning and characteristics of the goods.
Upon valid withdrawal, the Company refunds all payments, including standard delivery costs, within 14 days. Reimbursement may be withheld until goods are received or proof of return is supplied.
Premium delivery services are excluded from refund.
Exceptions include unsealed hygiene goods, personalized goods, commenced digital content, rapidly deteriorating goods and goods inseparably mixed after delivery.
Failure to provide mandatory withdrawal information extends the withdrawal period to 12 months until compliance occurs.

Voluntary Extended Return Policy (100 Days)
In addition to the statutory 14-day withdrawal right, the Company grants a voluntary commercial return privilege allowing returns up to 100 days after physical receipt of the goods.
This voluntary policy is supplementary and does not substitute or limit the statutory withdrawal right.
Returns under this extended policy are subject to the following conditions:
– Goods must be in undamaged, unused and resaleable condition.
– The consumer bears the direct cost of returning the goods.
– The consumer is responsible for diminished value resulting from handling, use or inadequate packaging during return transport.
– Items excluded from the statutory withdrawal right are also excluded from this voluntary policy.
– Refunds under the 100-day policy apply exclusively to the product value and exclude original delivery costs.
– The Company may refuse returns if goods deviate from the required condition.
This policy does not affect statutory guarantee or conformity rights.

Modification of Terms
The Company may revise these Terms at any time. Continued use constitutes acceptance of modifications.
